Terms and Conditions

Last Updated: February 9, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the AIPA application and related services (“AIPA,” the “App,” “we,” “us,” or “our”), provided by Zero Curb Shower Systems LLC [or AIPA LLC once applicable].

By creating an account, purchasing an assessment, or otherwise using AIPA, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About AIPA

AIPA is a home assessment and planning tool designed to help individuals and professionals evaluate features of a home that may affect accessibility, safety, comfort, usability, and the ability to remain in the home over time.

AIPA allows users to complete assessments, answer questions, identify levels of concern, add photographs, enter notes and recommendations, create action items, and generate assessment reports.

AIPA may be used by homeowners, family members, caregivers, contractors, occupational or physical therapy professionals, aging-in-place professionals, and other individuals or professionals.

2. AIPA Is an Assessment and Planning Tool

AIPA provides information and organizational tools to assist users in evaluating a home. The App does not guarantee that a home is safe, accessible, suitable for a particular individual, or compliant with any specific building code, accessibility standard, medical recommendation, or legal requirement.

Assessment questions, suggestions, reports, and other information provided through AIPA are intended to help identify matters that may deserve further consideration.

When appropriate, users should consult qualified professionals, such as licensed contractors, electricians, plumbers, healthcare professionals, occupational therapists, physical therapists, accessibility specialists, engineers, or other appropriate professionals before making decisions or modifications.

AIPA is not a substitute for professional medical, healthcare, engineering, legal, building-code, or other specialized advice.

3. User Accounts

Certain AIPA features may require an account.

You agree to provide accurate information when creating and maintaining your account and to take reasonable steps to protect your login credentials.

You are responsible for activity conducted through your account and should notify us if you believe your account has been accessed without authorization.

You may not use another person’s account without authorization.

4. Assessments and User-Provided Information

Users may enter information into AIPA, including:

  • Assessment responses.
  • Names or identifying information associated with an assessment.
  • Property information.
  • Photographs.
  • Notes.
  • Recommendations.
  • Levels of concern.
  • Action items.
  • Information about contractors, service providers, or other members of a user’s trusted home team.

You are responsible for the accuracy and appropriateness of information you enter into AIPA.

If you enter information about another person, you are responsible for ensuring that you have appropriate permission or another lawful basis to provide that information.

You should avoid entering information that is unnecessary for completing or documenting a home assessment.

Our collection and handling of personal information is further described in the AIPA Privacy Policy.

5. Photos and Other Content

You may be able to upload photographs and other content as part of an assessment.

You retain ownership of content you submit to AIPA.

By submitting content, you give us the limited permission necessary to store, process, display, reproduce, and otherwise use that content for the purpose of operating AIPA and providing the services you request, including generating and delivering assessment reports.

You are responsible for ensuring that you have the right to upload any photographs or other content you provide.

6. Professional Users

AIPA may be used by professionals when conducting assessments for homeowners, clients, or other individuals.

Professional users remain responsible for their own professional services, recommendations, representations, licensing requirements, insurance requirements, professional standards, and compliance with applicable laws.

AIPA does not supervise, certify, endorse, or guarantee the work or recommendations of a professional simply because that professional uses the App.

7. Purchases and Assessment Credits

Certain AIPA features or assessments may require payment.

Prices, available packages, promotions, and the number of assessments included in a purchase will be shown at the time of purchase.

Purchases made through an app store may also be subject to the applicable app store’s payment terms and policies.

Except where otherwise required by law or expressly stated at the time of purchase, purchases are subject to the refund and cancellation policies presented through the applicable purchase method.

We may change pricing, packages, promotions, or available services for future purchases. Changes will not alter assessments or credits already purchased except where reasonably necessary to operate the service or comply with law.

8. Acceptable Use

You agree not to:

  • Use AIPA for unlawful, fraudulent, or abusive purposes.
  • Attempt to gain unauthorized access to another user’s account or information.
  • Interfere with the operation or security of AIPA.
  • Introduce malicious software or harmful code.
  • Copy, reverse engineer, reproduce, or exploit the App except as permitted by law.
  • Use AIPA in a manner that infringes another person’s rights.
  • Submit content that you do not have the right to provide.

We may restrict or suspend access when reasonably necessary to protect AIPA, its users, or others, or to comply with applicable law.

9. Reports and Recommendations

Reports generated through AIPA reflect information entered during an assessment and the functionality available within the App at that time.

A report should not be interpreted as a guarantee that every possible safety, accessibility, maintenance, construction, medical, or aging-in-place concern has been identified.

Conditions within a home can change after an assessment is completed. Users should reassess a property when circumstances, health needs, household needs, or the physical condition of the home materially change.

10. Third-Party Professionals and Services

AIPA may allow users to record information about contractors, tradespeople, healthcare professionals, service providers, or other third parties.

Unless AIPA expressly states otherwise, the inclusion of a person or business in an assessment, report, recommendation, directory, or “Trusted Home Team” entry does not constitute an endorsement or guarantee by AIPA.

Users are responsible for evaluating and selecting any professional or service provider they choose to hire.

11. Intellectual Property

AIPA and its underlying software, branding, design, assessment structure, original questions and content, graphics, logos, and other proprietary materials are owned by or licensed to AIPA and are protected by applicable intellectual-property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable right to use AIPA for its intended purposes. They do not transfer ownership of AIPA or its intellectual property to you.

12. Availability and Changes to AIPA

We work to keep AIPA available and functioning properly, but uninterrupted or error-free operation cannot be guaranteed.

We may update, improve, modify, add, or discontinue features when reasonably necessary to maintain, secure, improve, or develop the App.

We may also update assessment questions and educational content as practices, standards, technology, or available information change.

13. Disclaimer of Warranties

To the extent permitted by applicable law, AIPA is provided on an “as is” and “as available” basis.

We do not guarantee that use of AIPA will identify every potential concern within a home, prevent accidents or injuries, produce a particular outcome, or establish that a home is appropriate for any particular person’s needs.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, AIPA and its owners, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of or inability to use the App.

AIPA is not responsible for construction work, home modifications, medical decisions, professional recommendations, or services performed by independent third parties based on information contained in an assessment or report.

Nothing in these Terms limits liability where doing so would be prohibited by law.

15. Privacy

Your privacy is important to us.

Our collection, use, storage, and sharing of personal information is governed by the AIPA Privacy Policy, which should be reviewed together with these Terms.

The Privacy Policy explains the categories of information AIPA collects, why the information is collected, how it is used, when it may be shared with service providers or other parties, how long it may be retained, and the choices or rights available to users.

16. Account Suspension or Termination

You may stop using AIPA at any time.

We may suspend or terminate access when reasonably necessary because of a violation of these Terms, misuse of the App, security concerns, legal requirements, or conduct that could harm AIPA or its users.

Where appropriate and legally required, users will be provided with notice or an opportunity to address the issue.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to AIPA, our business practices, or applicable legal requirements.

The updated Terms will include a revised “Last Updated” date. When required, we will provide additional notice of material changes.

Continued use of AIPA after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law provides otherwise.

Any dispute-resolution or venue provisions included in the final version of these Terms should be reviewed for compliance with applicable state and federal law.
